To facilitate smooth regulation compliance and quality production, the Ministry of Mines, Government of India, has modified the Primary Lead (Quality Control) Order, 2025. This amendment was published in the Official Gazette, S.O. 4367 (E) on 25th September 2025, which amends the previous date to the new date of 17th April 2026.
The revision follows consultations with the primary lead  IS 27 industry and aims to provide a regulatory environment that promotes a strong quality ecosystem, whilst providing the industry an adequate time frame to prepare.

Legal Basis and Authority of Primary Lead Certification under BIS Scheme-I

The amendment has been made under the authority granted by Subsections (1) and (2) of Section 16, Section 17, and Subsection (3) of Section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016). The Central Government, after having consulted the Bureau of Indian Standards (BIS), came to the conclusion that there is a public interest in making a change to the time frame for implementation. The notification was signed on behalf of the Minister of Mines.

Key Provisions of the Amendment Order of Primary Lead

  • Title and Commencement: The new notification is officially titled the “Primary Lead (Quality Control) Amendment Order, 2025." It shall come into effect on the date of publication in the Official Gazette, i.e., 25th September 2025. 
  • Change to the Effective Date: The key change to this amendment relates to the effective date of the original Quality Control Order. As part of the new text, this order shall come into effect on and from 17.04.2026.”

Background of Primary Lead and Quality Standards

Indian Standard 27 is an important raw material used in various industries, including battery production, construction, electronics, and industrial uses. It is necessary to ensure its quality for safety, the performance of a product, and the protection of the environment.

The original Quality Control Order (QCO) was established by the Ministry of Mines as a means to assure the quality of Primary Lead through a requirement to 'conform' to Bureau of Indian Standards (BIS) standards. The order states that no person shall be engaged in the manufacture, store, sell, distribute, or import Primary Lead unless it is with a valid BIS certification and proper application of the Standard Mark: (ISI Mark).

The revised timeline, which is now 17th April 2026, grants additional time to submit applications and obtain BIS licences. After this date, any person or entity not complying with the requirements will be liable for penalties under the BIS Act, 2016.

The introduction of the QCO will ensure that Primary Lead of a consistent quality will be available in the Indian market. In addition, the QCO will protect downstream industries that apply lead in more sensitive applications.

3. For Regulators:

The amendment provides an adequate timeline for the regulators to engage with testing laboratories and streamline the certification process.

Conclusion
